2020.09.30 02:44 bizzlemarie 2017 vs 2021 Hyundai Tucson

Option 1: 2017 Hyundai Tucson Sport with the 1.6L Turbo, $19k with 27,000 miles, 6% interest as of now(waiting on answer from credit union to try & get the interest to 3-4% possibly), OTD $22k. I have a trade-in I'm 3,400 upside down in, but I'm putting down 2,400 cash. Factory warranty on powertrain runs out in 2 years on Oct 27th 2022 & included in the $22 OTD price is an extra warranty for powertrain+computeelectrical/etc I added that last 5 years from the date of purchase up to 125k miles within those 5 years. The catch is the carfax history says it was used for 3 years as fleet/lease, so I'm unsure how hard it's been driven. I know this trim/year has a dual clutch transmission, my current car has one & I love them, but know they have to be driven a certain way which causes more concern with the fleet/lease use. Buying through carmax, so will have the 7-day period to return (will be having my mechanic check the car out fully then).
Option 2: 2021 Hyundai Tucson Value, $25k with basically no miles, OTD $28k, 0% interest rate. I would have 5 more years on the powertrain warranty coverage, but the electrical/computeetc warranty is 5 years with both options. The value trim has less get up & go power, also the trunk is not an automatic open & close like the sport (which will come in handy I think since I'm due with my first baby this winter). Buying straight from the Hyundai dealership.
I've made horrible financial decisions on the last 3 cars I have bought & typically just jump right into whatever sounds new & flashy, I have no idea if these are good numbers, so I'm desperate for some opinions on what to do here!
EDITED TO ADD: I really don't want a $28k loan, but if I'm totally screwing myself on the 2017 I would suck it up.

Just a bit of context:
The US Census was supposed to start on April 1st. But Covid.
The end date is mandated by the Constitution. It needs to be done by October 30th.
It got started late as could be managed, until the people in charge of implementation said "Here is the last possible date to start if we're gonna do this thing the Constitution says we gotta do."
Census got started.
The Trump administration said "Oh that's so cute that you wanna do this right! But we're going to take 33% of your working time away!" and they moved the already-tight deadline up a month.
The Census workers started running around like their hair was on fire, scrambling to get the project done in only 2/3 the time.
The courts said "Nah, Orange Man. The deadline is Oct 30, for reals."
The census workers put their hairfires out, and started enumerating all the places that were going to not get done under the truncated deadline. (The San Juan Islands here in Washington were probably not going to get enumerated under the short deadline. Members of my team were flown to Tucson to help their count. Montana is still only one-third counted.)
The Trump administration tries implementing measures in the background to sabotage the count, while appealing the deadline "extension". They plead "safety concerns" for the poor enumerators.
The federal courts issued an injunction giving Our Dear Leader until noon Pacific today to give a good reason as to why he's fucking with the Census.
At 9:55 this morning, the honcho of the Everett office sent out an urgent email saying that all enumerators and supervisors are to stand down, stop doing anything, don't close any cases you might be doing, don't board any of the ferries to go to the San Juan Islands... go home and await further developments.
Meanwhile, enumerators who haven't been following the court cases and political wrangling are suddenly being told to set down their equipment and back away with their hands in the air, disperse to their homes quietly...
I mean, I pay attention to this stuff, and I was shocked and concerned when I got the email telling everyone to freeze in place. I was having visions of 9/11, wondering if a tsunami was racing for the coast, assassination...
It's not that bad. It just feels like the first domino in a surging disaster scenario as all of the underpinnings of the Federal system that have been getting eroded for the last 4 years suddenly begin to crack and spit out gouts of sawdust as they begin to collapse.

2020.09.17 04:10 PortSided Can Play For About 10 Minutes, Then CRASH!

I've owned MSFS 2020 since the release date. Have put in several flights to and from a variety of locations in a variety of aircraft. The program has behaved well, right up until about 3 or 4 days ago. Now the program crashes to desktop (CDT) after +-10 minutes. It doesn't matter what I'm flying (tested A320, Cessna 172, TBM) or where I'm flying (I've tested Tucson AZ, Nice France, Long Island NY) or what weather (live, clear skies, etc.) It doesn't even matter if I'm flying at all. MSFS will CTD after 10 minutes just sitting on the main menu or creating a flight in the World Map. I installed today's patch and it's still crashing after 10 minutes. I've also tried flying with all data connections completely off, it lasted longer (about 20 mins) but ultimately still CTD. I've racked my brain over this one and I can't figure out what the common denominator is.
My specs are: i7-9700 - Radeon RX 5700 (8gb) - 16gb RAM

No one knows how these heatwaves kept on coming while increasing its temperature every year blaming Global Warming. During the daytime, the temperature has reached 65 degrees Celsius. Not even a dog can walk on the road when exposed to extreme heat dies. Some residential houses burned down due to the heat of the sun and forest fire is everywhere. Many cities were abandoned, massive exodus and food shortages. Most people traveled at night and on daytime, they look for shelters in the caves or tunnels to avoid the heat waves of the sun. All communication breakdown including electricity, and water systems. Planes crashed down, cars won’t start, and the ship’s engine malfunctioned.
The National Oceanic and Atmospheric Administration - NOAA has just announced that there’s a Solar Storm coming. The surface temperature of the sun has been increasing rapidly for four decades now and is expected to come most worse in the coming days. They have expected the massive Coronal Mass Ejection will directly hit the Earth at exactly August 17, 2083, Tuesday 8:32 AM.
Layla and Marcus were at the concrete bunker protected by lead sheets, constructed by their father when they were kids. Their father was an engineer and a contractor who build a highway and bridges. At the garage are all types of heavy equipment.
LAYLA: Are we not going to leave this place and move north where the others do? They say that there’s an underground bunker that can protect us from the CME.
MARCUS: Do you know what will happen to us when we don’t make it to the cave or tunnel when the sun is up? We will burn to death. Do you have any options aside from this?
LAYLA: We can convert the bulldozer as our transportation. We’ll install lead sheets around the operating area and fuel tank with the iron sled. We can make the route map of all the location gas stations until we reach our target destination. Likewise, we can travel during daytime and nighttime.
MARCUS: So, we don’t need any more caves and tunnels on our trip for shelters. I think this is a good idea. Let’s do it. We can go to Sahuarita. There’s an underground bunker there used by Titan missiles during the cold war. It’s a week trip by the bulldozer.
During the nighttime, Layla and Marcus went out of their bunker and watched aurora borealis in the sky. It takes 4 to 5 hours to cool down the road at night before they can use their bicycles. Although they have stocks of canned goods, water, and medicine on their bunker, they still go around at night looking for more water and fuel.
Meanwhile, somewhere at Ross Archipelago Antarctica under Bunker No. 832, on the helipad stations, there was a group of people going down from dozens of V-238 Osprey, mostly coming from the elite families around the globe (0.0001% of 10 billion population on 2083). This bunker alone can accommodate up to 832 human beings for 500 years with complete facilities and electrical power. At 2030, NASA scientist had already calculated the Solar Storm that would take effect on August 17, 2083. The elite society has covered up the story concerning the coming of the 8th Extinction Level Event. The media blocked the truth on why Earth is getting hotter each year, blaming Global Warming, not the coming massive solar storm. In the later years, the whole world knew about the solar storm. MARCUS: Thank God, we made it, Layla.
As they reached the Titan Missile compound, there were so many people gathered at the gate waiting for their turn to come inside the elevator. Time was running out. They decided to push through the heavily wired fence with the bulldozer, creating a stampede, everyone’s trying to get inside the elevator. There were commotion and panic, one by one, men and women at the front were shot and killed by the U.S. Marines, open firing to the resisting crowd. Just thought I'd clarify since there are/will be some people asking this over and over again. (Hopefully I can get this stickied)
Hyundai releases these Recalls Early with no remedy available, because the NHSTA makes them. They tell the NHSTA "well have the remedy available at x time and will send memos out then" this one is October 30th. It doesn't mean you can't take your vehicle into the dealer and ask if they can put you into a rental. However, you have to be within the date ranges Hyundai has specified. So grab a pen and paper and head out to your car. Open your driver's door, and either on your "B Pillar" (or the pillar that separates the front from the back) or on the side of your door, there is a black plate with a bunch of numbers. There should be a date manufactured in the top left corner of that.
The affected vehicles include: • Certain Model Year 2019 Hyundai Tucson vehicles produced from September 1, 2018 to July 31, 2019 by Hyundai Motor Company (“HMC”) in South Korea for sale in the U.S. market may contain a defective circuit board in the ABS brake hydraulic electronic control unit (“HECU”). • Certain Model Year 2020 Hyundai Tucson vehicles produced from December 01, 2019 to March 31, 2020 by Hyundai Motor Company (“HMC”) in South Korea for sale in the U.S. market may contain a defective circuit board in the ABS brake hydraulic electronic control unit (“HECU”). • Certain Model Year 2021 Hyundai Tucson vehicles produced on June 23, 2020 by Hyundai Motor Company (“HMC”) in South Korea for sale in the U.S. market may contain a defective circuit board in the ABS brake hydraulic electronic control unit (“HECU”). (2021s aren't sold yet, and Dealers have to hold them back until this recall is completed)
If your Tucson falls within these date ranges, you are most likely going to have this recall put out onto your vehicle.
"Is it safe to drive?" YES, however if your ABS light comes on for no reason, have it towed to the dealer.
"Can I bring my car to my dealership prematurely?" YES, however make sure your car is in those date ranges above, otherwise they may not help.
"What will they do with my car?" The guidelines given to dealers by Hyundai are to park it in a safe location, and disconnect the 12v battery from the car.
"Can I get a service loaner or Rental from my dealership?" The guidelines say, yes you can get one. However it's up to your dealer and what they would like to do.
As I receive more information within the next couple weeks (probably won't happen) I'll update this post.
EDIT: The same thing goes for the unreleased Santa Fe ABS issue as well

This may be a stupid and unanswerable question, but I need to get electrical run out to my backyard workshop, and want recessed lighting installed in the kitchen. I'm a quite capable carpenter and can do entry-level plumbing, but electrical stuff more complicated than swapping an outlet isn't in my wheelhouse at all. So I picked an electrician for an estimate because they get good reviews and their website is actually up to date, has pictures of good-looking work, and, importantly, emphasizes their commitment to covid safety. The company is really responsive to emails/calls and seems well organized. The estimator came, all masked and gloved and super professional, answered all my questions and made reasonable suggestions for the lighting layout. So, yay.
But, this part of the estimate made me choke a little: "Run a new 60 amp subpanel feed out to the north wall of the house from the utility closet on the west side. Run surface-mounted conduit along the west exterior wall of the house around the corner and continue conduit to a surface-mounted outdoor subpanel. From the subpanel, install an outdoor rated enclosure with a 30 amp/240 receptacle for a welder, and a separate box with two separate GFCI receptacles. $1,957.94"
That figure seems like a big pile of money to me, but I have zero frame of reference for this sort of thing. The total conduit length would be about 60', not buried. I'm in central Tucson. Can anybody tell me if this sounds about right or if I definitely need to suck it up and get another estimate? I'm tempted to say screw it and go ahead and hire them simply because I don't want the stress of having another person come into the house who might not be so rigorous. Is that peace of mind worth overpaying by a couple hundred? Yes. Five hundred? quite possibly. Making decisions in plague times sucks, help.

The word on the street (maybe not the streets, mainly from my dad, who stays up to date on cars) is that Kia has made a huge improvement over the last several years, similar to the improvements seen in Hyundai (due to Hyundai purchasing Kia if I remember correctly).
However, as I am researching a new car to buy, I am still seeing so many “be wary of Kia” and “don’t fall for the red Kia” things on the internet (written recently).
So which is it? Is Kia a good and reliable car now? Or are the old stigmas still true?
I’ve been driving a Hyundai Elantra for 10 years and it’s been a great vehicle. Apart from a couple of minor interior cosmetic complaints, I have had no issues with it the entire time I have driven it. I feel good about Hyundai’s. I was all but settled on getting a Hyundai Tucson, but we are now strongly considering a 3 row SUV. The Hyundai Palisade is out of budget but I am looking into the Kia Sorento now. It seems to hit all the major things for us but I can’t get this “stay away from Kia’s” thing out of my mind, even though I think my dad is one of the most knowledgeable people when it comes to car reliability/quality.
(Open to suggestions for other 3 row SUV’s. $20k is upper limit of budget. Will buy used but want it to be new enough (2017-2019) to be comfortable and reliable for the next 10+ years)

2020.09.05 22:24 braincatcleo2 Technically can afford new car, but not sure if should go new vs cheaper used

I (late 20s) recently moved to Maryland and my current car failed the state required safety inspection. Repairs are more than its worth, it's old (2005) and I've been driving it for about 7 years. I was planning on driving it for another 1-3 years or at least until it died, saving up, and then buying a new to me car outright. Instead, I'm looking at buying a car now through financing, it just doesn't make sense to put any more money into this car and this would be the second bigger set of repairs I've needed to do in the last year or two.
I'm not really happy/comfortable with financing, but it seems like the best option for right now. and I'm not sure if what I planned to do once I had money saved makes sense now or not. My plan was to save up enough to buy an SUV with cash or close to all cash, and buy one probably at the middle to high trim level. I've been driving a 4door sedan with little features and was hoping to treat myself a little.
I just can't figure out how much to spend now and what is reasonable. I've never had monthly payments on any loans yet (student loans starting soon) and it makes me a bit nervous. I was also planning on saving for a house down payment first, then focusing on car (or at least like 70/30 house/car).
I just started a new job, going from low salary student to ~130k gross pay. I've only had one paycheck so far and I can't really tell how much my pay will be monthly because the first paycheck also had taxes taken out for moving expenses, but I'm assuming around $8k a month.
I will soon have student loan payments $800-900 a month (just graduated in july so in January I think), though I would ideally like to pay more and would like to start paying on them before the repayment date.
Budget $2030 Rent
$700 for utilities, phone, internet, groceries, netflix etc.
$900 for student loans
$100 for car insurance (though I expect it will go up)
$900 to RothIRA (i'd like to maximize my contribution this year as it is the last year I can due to salary increase. Starting with saving this month for it)
Total: $4630
Remaining: $3370
The remaining will go to house down payment savings, extra to student loans, rainy day savings, other random purchases and whatever the car loan is.
My instinct is to go as low as I can in car monthly payments, e.g. go used and aim for $250-350 (60-72 month loan, or $500-600 36 month loan) a month. but I'm not sure if that is smart because the resale value of the car won't be great. I'm looking at 2017 SUVs (Tucson or similar)for between $17k-20k. New seem to be between $26-30k.
I have an offer for my car for $1700 from carmax and can right now do an additional $2500 down payment. I could stretch and add an additional $2000 if really needed.
Technically though I can afford a higher monthly payment, and if I go new the resale value will last longer and be better, but the trade off is less for house and student loans.
I've never bought a car before (current one was passed down from parents) and going to a dealership sounds like a nightmare so that is also stressing me out. Any words of advice?

What's it like?

While Reddit is about messages and posts, Discord is just free form chat. There are channels for our main cities, Phoenix, Flagstaff, and Tucson, but we have people from all across the state.
We also have topic channels that include:
...and a general Lobby channel just to hang out and say hello.
There are over 4,500 members and someone is on there pretty much 24/7 if you're looking for someone to talk with. It's 18+ and a bit more chill than Reddit overall, and there are a lot of people on the Discord now who you won't see on Reddit at all. It's a related community, but with a very different feel. I should probably point out that it is not a dating server and we taking creeping and harassment very seriously.
In the Before Times there were a lot of meetups and events, and now they're doing some virtual things including movie nights and book clubs.

How do I join?

It's super simple.

  2. Go to the #introduction channel and post a little bit about yourself. We ask people for an intro to try and reduce trolls and spammers. Once you do that you'll get access to the full server.

I purchased a 2016 Hyundai Tucson Sport a few weeks ago from Carvana. It was under blue book and quite a bit cheaper than anything from local dealers. Initial process was very smooth. I already had pre-approval through USAA, so after selecting the car I only needed to call Carvana to confirm financing info. I remained on the line while they called my bank, only took about 10 minutes. Delivery was in-market and was scheduled for three days later.
The day before delivery I received a notification that it would be delayed and needed to call and reschedule. They assured me that it wasn't an issue with the car itself, just logistics. I got a new delivery date for 3 days later. Delivery driver called that morning to say she would be 15 minutes late as she wanted her detailer to work on a stain on the seat. Overall the delivery was very smooth, car was in great shape, although it really wasn't detailed very good. After signing the agreement, the delivery driver attached a Georgia(?) paper temporary plate.
I had a shop inspect the vehicle during the 7 day period and it was in great shape. Only needed an alignment and the battery would need to be replaced soon. I had both done and then called Carvana. They are sending a $100 check for the poor detailing and then directed me to SilverRock for the repairs. SilverRock sent a reimbursement check for the alignment and new battery which arrived on day 9.
On Day 8 the website dashboard indicated that all registration paperwork had been sent to DMV, and nothing else would be needed from me. Hopefully this goes smoothly as well. USAA showed my loan application as pending for the next two weeks before it finalized.
So far I've been really happy and the process has been pretty painless. Definitely better than having to deal with a local dealer. The delivery delay was annoying but not a big deal in the end and I was already expecting it based on posts here. I love the car and will definitely consider using Carvana again next time I'm shopping for another.
Did not receive referral codes as I'm in California.
Update: I received my plates and registration via FedEx yesterday. That makes it exactly one month after the car was delivered. I had two weeks left on the temporary tag.

Hey Lumberjacks, friendly Sun Devil grad student/ASU Biodesign Institute researcher here. Shit's getting pretty crazy down here in Tempe, and it doesn't look like things are much better up in Lumberjack country.
I'm not sure what it's like trying to get a COVID-19 test at NAU (I know y'all have some tests that give results pretty quickly), but I wanted to let y'all know that ASU's offering our in-house saliva test for COVID-19 for free to anyone in AZ (you don't need health insurance and you don't need to be an AZ resident). You can get tested as often as you'd like through this mechanism, and you can registesee when and where the tests will be offered here. Some of the testing dates/locations are actually at NAU (not sure if they're advertising it often or not to y'all).

Notes from postvasectomy:
Todd asks the doctor about vasectomy complications beforehand. Doctor gives the typical "vasectomy is safe, sometimes complications happen, including epdidiymitis which usually goes away on its own but very occasionally becomes chronic" type warning. Todd asks what about erectile dysfunction, doctor says any problems with erections would be "in your head." No big deal, really. Men hardly ever even call me after their vasectomy. This is such a chill procedure that even if you do call me, I might not even bother returning your call.
Todd goes in for the vasectomy Nov 2005. Some trouble during the vasectomy where he has retracted testicles that maybe caused the procedure to be more difficult and painful than it should have been. Four days later he goes to help coach youth skiing and tries to take it easy. He feels some minor pain when he is turning. A few days later he helps move a Christmas tree.
Things don't go well in December, and he talks with the doctor to tell him about his various pains, including leg pain. Doctor suggests Neurontin to help with the pain. January, Todd goes to his GP who schedules him for a visit with a urologist. February he goes to the Emergency Room twice complaining of pain. March, he visits the urologist who says the vasectomy looks good and maybe pelvic floor dysfunction. He has been unable to have sex with his wife since the vasectomy. He gets (spermatic cord?) injections and starts asking about a reversal. First doctor discourages getting a reversal. He goes to Dr. Burrows for a reversal, feels ok for a few weeks, then seems to get worse and worse.
He tries botox, lidocaine infusions, ketamine. At some point he has at least one testicle removed, which also doesn't help. He can't hold a job because he is in too much pain and can't sit in a chair. He tries to kill himself.
More than 10 years after the vasectomy, he tries to sue the urologist who did his vasectomy, arguing that:

I'm reminded of the American Urological Association statement:
Chronic scrotal pain associated with negative impact on quality of life occurs after vasectomy in about 1-2% of men. Few of these men require additional surgery.
That last sentence there "few require additional surgery" is presented as if to say that the pain that 1-2% of the men experience is not really very bad. Not bad enough to "require" surgery. I suppose this would be a correct way of looking at things if there were a simple, inexpensive, low-risk and effective surgical treatment available. But as Todd's story shows, more surgery comes with the risk of even worse quality of life. Sometimes, your best option might be to accept that your vasectomy has left you visiting the emergency room periodically, unable to have sex and unable to have a pain-free day. Few indeed are so desperate that they "require" additional surgery that may make their already terrible situation even worse.

This is an action by the Plaintiffs as against the Defendants for medical negligence as a result of complications that arose after the Defendant, Dr. Macdonald, performed a vasectomy on the Plaintiff, Mr. Muir. The surgery took place on November 30, 2005, at the Defendant’s clinic in Banff, Alberta.
In 2005, Todd and Kathleen Muir had been married for approximately 17 years. They had two sons. After some difficulties arose with their then method of birth control, they made the conscious decision not to have any more children, and decided to investigate the best method to ensure that happened. After much discussion, they decided to investigate whether a vasectomy was a suitable option for Mr. Muir.
The procedure was performed on November 30, 2005 and after the procedure, Mr. Muir had a number of difficulties and eventually developed chronic pain which has had a significant impact on his lifestyle and career.
Mr. Muir was an active youth and was involved in skiing, hockey, baseball, motorcycle and snowmobile riding. He had no significant injuries at the time of the surgery.
Mr. Muir sought treatment for the chronic pain that he said he suffered after the vasectomy. He met with, or consulted with, or was treated by numerous treatment providers.
The Defendant’s position is that a later surgical intervention caused the Plaintiff’s injuries, not anything related to the vasectomy.
The Plaintiffs submit that Dr. Macdonald breached the standard of care in the procedure itself and also by his actions both pre and post-surgically. According to the Plaintiffs, a patient who presents with retracted testicles should not undergo a no-scalpel vasectomy in that condition. The patient should be given a Valium, soak in a hot tub or have a hot towel to relax the testicles to see whether they were in a condition where a safe procedure can be performed. Furthermore, the epididymis is an extremely sensitive part of the male anatomy and prolonged contact with this area increases the risk of complications with the vasectomy. In this case, Mr. Muir presented with retracted testicles, which put him at a higher risk.
The Plaintiffs submit that Dr. Macdonald did not perform a physical examination of Mr. Muir’s genitals before beginning the procedure. The Plaintiffs also allege that Dr. Macdonald did not freeze Mr. Muir’s genitals appropriately.
According to the Plaintiffs, Dr. Macdonald should have stopped the procedure on the right side when he encountered difficulty trying to find the left-side vas deferens. At no point did Dr. Macdonald stop the procedure to advise Mr. Muir that it was taking longer than usual to complete the procedure. When Dr. Macdonald pierced his left-side vas deferens Mr. Muir felt extreme pain.
The Defendants submit that Dr. Macdonald did not breach the standard of care. He performed the no-scalpel vasectomy on Mr. Muir in accordance with his standard practice for no-scalpel vasectomies. The Defendants submit that the vasectomy proceeded without complication.
According to Mr. Muir, Dr. Macdonald encountered difficulties on the left side. Dr. Macdonald made the comment “I can’t find your left. I can’t find your vas”. Mr. Muir recalled that he grabbed the doctor’s arm and said you have to stop. During direct examination, Mr. Muir testified as follows:
Q. All right. Did he complete the procedure?
A. It took a while and then he did make the comment, "I found it". And then the next thing I knew he’d cut it.
Q. And when he cut it, what did you do?
A. By this time, and I don’t know, the freezing hadn’t taken great or it had worn off, whatever you say, but on this side I literally felt myself arch my back and buck up on the table and I could feel huge pain when he cut the left.
Mr. Muir testified that when he left the Clinic he was sore down in the “lower end”. He was not walking normally. He managed to get into his car and drive home. He stopped at one point to get out of the car and stretch. This was not because of his condition but because he wanted a break.
The after-care for the no-scalpel vasectomy was described on the pamphlet. Mr. Muir recalled there were some directions about heavy lifting and icing areas that were sore. He followed the procedure exactly. He had bruising and swelling. He was unsure when the bruising faded away although with time he started to improve. Mr. Muir recalled that he read somewhere that he could not have unprotected sex for a while. Once that period of time elapsed, he and his wife resumed sexual intercourse but Mr. Muir experienced a great deal of pain when he ejaculated. They tried a few more times but his pain continued. He began having pain in his left leg. Mr. Muir also started getting pain in his left foot whenever he sat. He found it was uncomfortable to wear tight clothing. Mr. Muir noticed that his left testicle had dropped lower.
Mr. Muir recalled helping with the family Christmas tree following the surgery. Because of his ongoing pain, he did not lift the tree but helped to steady it. He was not bent over but he bent his knee slightly and then he felt pain in his left scrotum.
In early December 2005, the ski season was just beginning. As he was head coach he was required to be present on the Lake Louise Ski Hill to help organize the students. He attended the ski hill [4 days after his vasectomy.] According to Mr. Muir, he would only take easy runs and check on groups. He felt some pain when he turned. He had no falls at this time. The sessions ran from 9:30 a.m. till noon and then again in the afternoon. He was involved in no other activities but he continued to ski for the duration of the 2005 and 2006 ski season.
Throughout the recovery process, he returned to walking normally. He still had pain shooting through to his left foot and after ejaculating.
Around the middle of December he called Dr. Macdonald. The first call was short as he was unable to speak directly with Dr. Macdonald. He then called again but still was not able to reach him. Following the phone messages, Mr. Muir sent an email to the Clinic. Shortly after he sent the email he received a call from Dr. Macdonald.
Mr. Muir explained to Dr. Macdonald that he was still experiencing pain. At one point, Dr. Macdonald commented that he sounded depressed and that he should come and see him and he would prescribe an anti-depressant called Elavil.
Dr. Macdonald confirmed that he would have advised Mr. Muir to take Elavil. He explained that it is a good second line drug because in low doses it is good for treating chronic pain and it is good for insomnia. In high doses it is used to treat depression.
Dr. Popowich did not believe that the shooting pain down the leg during ejaculation could be related to the no-scalpel vasectomy. The nerve that supplies the leg is nowhere near the operative site. This Court finds that Dr. Macdonald met the standard of care in all respects with the exception of failing to return Mr. Muir’s phone calls in a timely manner.
At this point in time, Dr. Macdonald’s involvement in the case ended. Following the surgery, Mr. Muir embarked on a long journey of procedures and visits with many medical practitioners.
January, 2006
Mr. Muir first went to see his general practitioner, Dr. McLaughlin. He could not recall if there was a physical examination. Following his appointment with Dr. McLaughlin he made an appointment with urologist Dr. Baverstock for March 2006.
Jan - Feb 2006
He attended at the emergency centre on at least two occasions in January and February 2006 as he continued to experience pain.
March, 2006
Mr. Muir saw Dr. Baverstock on March 6, 2006. When Mr. Muir explained his symptoms to Dr. Baverstock, he investigated possible cancer or prostrate problems. He prescribed Flomox and sent Mr. Muir for a cystoscopy to look at his bladder. The lab tests and scrotal ultrasound were normal. The physical examination was normal. Dr. Baverstock suspected pelvic floor dysfunction or spasm and recommended conservative treatment in the form of medication and physiotherapy. Based on his physical examination of Mr. Muir he thought he had had a good vasectomy.
Mr. Muir also saw Dr. Balharry, a general practitioner in Canmore. He saw Dr. Balharry on a number of occasions. He tried a number of injection treatments. On a couple of occasions the injections helped with the pain but the relief was not permanent.
May, 2006
Mr. Muir also saw Dr. Shields and Dr. Amundson, both urologists in Lethbridge. He saw Dr. Shields about obtaining a vasectomy reversal. Dr. Shields did not think this would be a good idea and specifically advised against it. Dr. Shields refunded his money as he did not want to do the reversal. Dr. Shields referred Mr. Muir to a pain specialist.
Dr. Shield’s examination of Mr. Muir’s epididymis, testicles and scrotum was normal. Dr. Shields could not determine the cause of Mr. Muir’s pain. Dr. Shields advised against a reversal. In his opinion it would likely aggravate rather than help alleviate the pain.
Mr. Muir also received a number of injections from Dr. Amundson.
Mr. Muir saw Dr. Abele, a urologist. Dr. Abele was not able to offer him a meaningful solution. He saw Dr. Hulyk, the father-in-law of one of his sisters. Dr. Hulyk made referrals and provided information.
Aug 2006
Mr. Muir found an American physician, Dr. Burrows, a urologist who specialized in vasectomy complications, in Tucson, Arizona. Dr. Burrows performed a vasectomy reversal in August 2006. Following the reversal, according to Mr. Muir, his symptoms improved for about three weeks. After three weeks he phoned Dr. Burrow’s office and advised he was experiencing a burning on the left side. He returned to Dr. Burrow’s office where Dr. Burrows checked the left side vas where they did the connection. His condition improved again. However, the pain and symptoms were not completely eliminated and the pain returned again.
Mr. Muir saw Dr. Burrows for a third time and there was further improvement. He still had a burning sensation in his feet and some pain in the left-hand side.
Mr. Muir continued to see doctors, including: Dr. Clark, a pain specialist; Dr. Aung; Dr. Levine, a urologist in Chicago, who specialized on post-vasectomy pain; Dr. Carslon; and Dr. Wilson, a neurologist. Dr. Wilson treated him with Botox. Although it provided temporary relief, it did not permanently relieve the pain. Dr. Robert and Dr. Binegar were two other doctors he saw. Dr. Binegar worked at the Mayo clinic in the United States. Dr. Brown worked in Montreal, a general surgeon who worked on groin injuries.
Dec 2010
Mr. Muir’s current physician is Dr. Ali. He has been treating Mr. Muir since December 2010. Dr. Ali recommended a number of treatments including ketamine infusions and lidocaine injections. Mr. Muir located these physicians and asked Dr. Ali to assist him in filling out the appropriate financial forms. Mr. Muir found some relief with ketamine infusions. Dr. Ali recalled that there was some improvement but Mr. Muir was having difficulty obtaining funding. There was also a clinical issue with respect to Mr. Muir’s blood pressure. Dr. Ali also noted that he “plateaud” with the ketamine infusion.
Dr. Ali also advised Mr. Muir that periphery nerve blocks would not improve his symptoms on a permanent basis. Mr. Muir wanted to proceed in any event.
The Plaintiffs submit that causation is established. Prior to the surgery, Mr. Muir was experiencing no pain. After the surgery, Mr. Muir left the Clinic with disabling pain. The only reasonable inference to be drawn from the facts is that something went wrong in the way the operation was performed.
The Defendant submits that if the chronic pain and decrease in functionality occurred regardless of Dr. Macdonald’s conduct, then the claim must be dismissed. According to the Defendants, the Plaintiff had the usual post-vasectomy pain but the pain became chronic as Mr. Muir exacerbated it by electing to go skiing and handling a heavy object within four days of the vasectomy. This was followed by numerous medical interventions. Furthermore, there was no objective medical evidence that Mr. Muir had complications or an infection.
Dr. Gordon did not examine Mr. Muir. Based on his review of the medical records, he opined that Mr. Muir probably has neuropathic pain that has been exacerbated by his various procedures, including the denervation and ilioinguinal procedures. Dr. Gordon noted that Mr. Muir has had various traumas to his nervous system. This led to sensitization and spread of pain outside the area of the nerves that were done.
According to Dr. Gordon, there is no clear evidence that Mr. Muir’s nerve was damaged. The initial spread down the left leg is supportive but not firm evidence. Dr. Gordon summarized the following in his expert report dated February 9, 2014:
Mr. Muir had so many other procedures that led to complicated neuropathic pain. These later surgical procedures have turned Mr. Muir’s pain into a nightmare of [neuropathic] pain, each one making him worse. Even the orchiectomy did not solve the problem. I cannot help but think that if he had stopped at the initial surgical procedure and tried a pain management program, in a comprehensive way that he would stick to, he may not have gone down this path. Unfortunately, however, he has had numerous surgical procedures, all hoping to make him better, and ultimately making him worse.
In Dr. Gordon’s opinion the initial pain experience by Mr. Muir in 2005 after the vasectomy was inflammatory. The procedure itself produced the inflammation leading to the release of inflammatory compounds. It is possible that the skiing on day four and the lifting of the Christmas tree a few days later could have stretched or damaged the nerve leading to further inflammation and pain or even nerve damage. The surgical site was traumatized by these activities.
For nine months following the vasectomy, Mr. Muir coached skiing, worked full-time, commuted to work in Lethbridge and exercised. This Court does not dispute that Mr. Muir experienced pain but he was able to carry on with daily living until he had the vasectomy reversal. He had a dramatic decline in functionality after August 2006. This Court has reviewed Mr. Muir’s evidence at trial that the vasectomy reversal and the removal of his left testicle by Dr. Burrows improved his condition in the long-term although not all of the pain and symptoms were eliminated. However, this evidence does not accord with such a decrease in functionality after the further medical interventions. It also does not accord with Mr. Muir’s continued pursuit of medical treatments. Therefore, I do not accept his evidence on this point. Although he may have experienced short term relief, ultimately, his situation worsened following the reversal and the further medical interventions. The Plaintiffs submit that the discussion of the risks of the procedure was inadequate. According to Dr. Pollock, Dr. Macdonald failed to obtain Mr. Muir’s consent for the procedure. The website (including the updated website) does not list post-vasectomy pain syndrome as a risk.
The Defendant’s position is that Dr. Macdonald’s consent discussion with Mr. Muir had to be consistent with the practice of a physician performing no-scalpel vasectomies in Alberta in 2005. The very small risk of chronic severe pain was disclosed to Mr. Muir prior to the no scalpel vasectomy in accordance with the standard of care required in 2005.
The Defendants submit that a reasonable person in Mr. Muir’s position would undergo the no-scalpel vasectomy if properly informed of the risk of chronic pain. Mr. Muir gave no evidence at trial that disclosure of this very small risk of severe chronic pain following a no-scalpel vasectomy would have caused him to decline the procedure.

Mr. Muir made a call and spoke with Dr. Macdonald. His questions to Dr. Macdonald revolved around the risks. He was concerned as to whether there was a risk it would affect his sexual performance. He asked some questions about physiology. He had four areas of questions. He asked whether the procedure could affect erections. Dr. Macdonald replied only if it is “in your head.” Dr. Macdonald appeared to be in a hurry. The phone call lasted approximately ten minutes. During the phone call, Mr. Muir was referred to the clinic’s website.
Dr. Macdonald testified that he always discusses the following risks with the patient:
I always discuss with patients the risk of any surgery. There’s a small risk of bleeding, infection. And with no-scalpel vasectomy, I always talk about the condition called Epididymitis which means inflammation of the epididymis.
Q Why do you always talk about that?
A Because it’s the most complication of vasectomy.
Q And what is that complication? Just describe it for the court.
A The complication is inflammation -- the pathology is inflammation in the epididymis. Usually this self-limiting and settles down but it is the commonest. It can occur in up to 6 percent of patients. Very occasionally it can become chronic.
The Plaintiffs submit that after the procedure Mr. Muir was no longer able to run, bend over or sit properly. He experienced constant pain which affected his ability to participate in sports, use of the toilet and sexual arousal. This interfered with his ability to participate in sporting activities with his sons and family activities such as hiking and family holidays. It has deeply affected his mental state to the point where he has attempted to take his own life.
The Defendants submit that Mr. Muir had the usual recovery pain expected from a noscalpel vasectomy. It is the events that transpired after November 30, 2006 which caused Mr. Muir’s pain to persist and become chronic, including handling the Christmas tree four days postsurgery and skiing at Lake Louise. Any general damages should take into account that Mr. Muir was able to work full-time, travel regularly between Cochrane and Lethbridge and ski the 2005/2006 season.
After the procedure, Mr. Muir skied for the remainder of the season. In 2006, when he started working for the City of Lethbridge he was able to participate in a slow pitch game and could still run to some extent. He was unable to play hockey. Mr. Muir was unable to ski the following year. He would have to drive out to the hill lying down. At one point in time he had to remain on the main floor of his house with a limited radius with one bathroom and one couch.
After he left the City of Lethbridge, he did some consulting for the Edmonton Ski Area. He then got a job with Pro-Am Motorsports in Calgary in sales. He then worked for Gold’s Gym in sales. He was let go from this job as he was unable to sit whilst speaking with clients. He then worked for the Town of Athabasca as general manager of a sports plex. As he wanted to be closer to home he obtained a job at the Okotoks Field House. This job was too stressful and difficult due to the standing requirements, so he was forced to quit. He then worked in Chestermere for six months at their recreation complex. He then obtained a job in Moose Jaw. He lives next to the sports complex and commutes home to Cochrane every two weeks. He has worked there for approximately one and half years.
Based on the evidence before me, this Court notes that Mr. Muir was fully functioning up until the vasectomy reversal. While, this Court does not dispute that Mr. Muir was still experiencing pain, he was still able to ski, work and drive.
Mr. Muir’s intimate relations with his wife were severely affected. Mr. Muir gave evidence that he was unable to have any sexual relations with his wife following the vasectomy.
After the vasectomy, Mr. Muir continued to work until undergoing vasectomy reversal in August 2006. Mr. Muir was off work for approximately six weeks following the second procedure and after returning to work for a couple of weeks in October was unable to work from OctobeNovember 2006 to 2013. He was then unable to work full-time until 2016. Mr. Muir was in receipt of short term disability benefits prior to his termination from the City of Lethbridge and then he was in receipt of CPP disability benefits from 2007 to 2015.
This Court finds that there is no future loss of income, due to this Court’s conclusion that Mr. Muir’s pain would have resolved within two years following the surgery had he chosen to pursue conservative treatment.
Based on the above findings, the Plaintiffs have failed to establish liability. That being the case, no damages are payable.
